Terms and licence

1. Who we are

formbar is made and sold by Bram Labs ApS, Fragevej 58, 4760 Vordingborg, Denmark, CVR 45916022 ("we", "us"). You can reach us at hello@getformbar.com.

These terms apply when you download, install, try or buy formbar, and when you use your account at getformbar.com. By doing any of those, you agree to them. If you buy for a company, you confirm that you can accept these terms on its behalf, and "you" means the company.

2. Your licence

When you buy formbar, we give you a perpetual, non-exclusive, worldwide licence to install and use formbar under these terms. "Perpetual" means it doesn't expire: the versions covered by your licence (section 5) keep working for as long as you want to use them.

• One person. A licence is for one person. If a company buys licences, it needs one for each person who uses formbar, and it can move a licence to another person (for example when someone leaves). Email us to move a licence.
• Personal and commercial use. Use formbar for hobby projects, client work, products you sell, or anything else lawful.
• All features. There are no tiers. Every licence includes everything formbar does.

formbar is licensed, not sold. We, and the authors of the third-party components described in section 8, keep the copyright and all other rights in the software.

3. Your computers and activation

You can use your licence on up to 3 computers at a time, on any mix of macOS, Windows and Linux. To add a computer, open formbar and choose Activate; this needs an internet connection once. After that formbar works offline.

To move your licence to a new computer, remove an old one in formbar or in your account. To stop a licence being passed around, we limit how often new computers can be added in a short time. If that ever gets in your way, email us and we'll sort it out.

When formbar is online it may check, at most once a day, whether its licence is still valid and pick up a renewal. It never needs to.

4. The trial

You can try formbar for free for 14 days on each computer, with every feature. After the trial, formbar still opens and still opens your files, so your work is never locked away, but saving and exporting need a licence.

5. Updates

• Every licence includes 12 months of updates from the day you buy it.
• Your licence covers every version of formbar released before your updates end, forever. You can keep using them, and reinstall them, as long as you like.
• A version released after your updates end needs renewed updates. Until then, formbar tells you so and your covered versions keep working.
• You can renew updates at any time for $59 for another 12 months. A renewal runs from the later of the day you renew and the day your current updates end. Renewing is optional.

6. Buying

• Prices are shown on the pricing page in US dollars and are one-time payments. They include VAT or sales tax where it applies.
• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it takes your payment, charges any tax, and sends your receipt or invoice. We never see or store your card details. Paddle's buyer terms apply to the payment.
• Your licence is delivered straight away, to your email and to your account at getformbar.com.
• Launch prices, like the founding price, are the same full product and the same licence. They are only a lower price.

7. Refunds and your right of withdrawal

If formbar isn't for you, email hello@getformbar.com within 14 days of buying a licence or a renewal, from the email address you bought with. You'll get a full refund, no questions asked. When we refund a licence, it stops activating and the computers it's on go back to the trial rules. When we refund a renewal, the updates period goes back to what it was.

If you are a consumer in the EU, you also have a legal right to withdraw from a purchase of digital content within 14 days. Our refund policy gives you at least that, whether or not you've started using formbar. To use it, tell us clearly that you want to withdraw. An email is enough.

The refund policy says the same on a page of its own.

8. Open-source components

formbar is built with open-source libraries, among them Open CASCADE Technology and Qt (through PySide6). They are licensed to you by their authors under their own licences, which come with formbar and are listed with links to their source code on our open-source page.

Nothing in these terms limits your rights under those licences. In particular, libraries licensed under the GNU Lesser General Public License (LGPL) ship as separate files that you may modify and replace with your own versions, and you may reverse-engineer formbar to the extent needed to debug such modifications. Section 9 does not apply to that.

9. What you may not do

Except where section 8 or the law gives you the right, you may not:

• share your licence, licence key or licence file, or use one licence on more computers than it allows;
• remove, disable or get around the activation, the trial or the licence checks, or help anyone else do so;
• copy, sell, rent, lend or redistribute formbar or its installers, other than installing them on your own computers;
• decompile, disassemble or reverse-engineer formbar's own code; or
• use formbar to break the law or anyone else's rights.

10. Your designs are yours

Everything you make with formbar belongs to you: your files, models, drawings and exports, and anything you manufacture from them. We claim no rights in them. formbar keeps your files on your computer and never sends them to us.

11. Check what you make

formbar is a design tool. You are responsible for checking your designs before you make or use them, including their dimensions, tolerances, strength, safety and fitness for your purpose, and that they meet any rules that apply to them. formbar is not certified for safety-critical uses, such as medical devices, vehicles, aircraft, or parts whose failure could hurt someone, and must not be relied on as the only check for them.

12. If something doesn't work

We work hard to make formbar reliable and we fix problems we find. If formbar doesn't work as described, tell us and we'll help. If you are a consumer, you have legal rights when digital content doesn't conform to the contract, including a repair, a price reduction or a refund. These terms don't limit those rights.

Apart from that, and to the extent the law allows, formbar is provided "as is". We don't promise that it is free of errors, that it will always run without interruption, or that it suits a particular purpose.

13. Our liability

To the extent the law allows, our total liability to you for anything related to formbar is limited to what you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits, lost data, failed prints, wasted material or machine time, or the cost of replacement products.

These limits don't apply to death or personal injury caused by our negligence, to fraud, to intentional or grossly negligent acts, or to any other liability that can't be limited by law, including under product liability law and consumer protection law.

14. Your account

You sign in to your account with a code we email you. Keep your email account secure, because anyone who can read your email can sign in as you. You can ask us to delete your account at any time (see our privacy policy).

15. Ending the licence

You can stop using formbar whenever you like. If you seriously or repeatedly break section 9, we may end your licence and remove its computers, after telling you and giving you a chance to put things right where that is reasonable. A refunded purchase ends that licence or renewal. Sections 8 to 13 and 16 continue after a licence ends.

16. Services in the future

We may one day offer optional services that cost money to run, such as cloud sync, collaboration or compute-heavy AI features, possibly as subscriptions with their own terms. The formbar app will never need a subscription to keep working or to open your designs.

17. Changes to these terms

We may update these terms, for example when formbar gains new features. Changes apply to purchases and renewals made after they are published. They never take away your right to use a version you have already bought. If we make an important change, we'll email you.

18. Law and disputes

These terms are governed by Danish law, and disputes go to the Danish courts. If you are a consumer, you also keep the protection of the mandatory laws of the country you live in, and you can bring a case there. Consumers can also complain to the Danish Consumer Complaints Board (Nævnenes Hus), or, if you live elsewhere in the EU, get help from the European Consumer Centre Denmark. We'd much rather you just email us first.
